Water Data Exchange (WaDE) Data and Software Terms of Service

1.  The Western States Water Council (WSWC) is a government entity, an instrumentality of each and every participating state, consisting of representatives appointed by the governors of 18 western states. WSWC created the Water Data Exchange (WaDE) Program in 2011 to assist WSWC member States in publicly sharing water rights, allocation, supply, and use data through a common streamlined and standardized service that enables regional analyses to inform water resources planning and policies. The WaDE Program developed the WaDE Data System, which includes the WaDE Database, Application Programming Interface (APIs) calls to access its data, and the Western States Water Data Access and Analysis Tool (WestDAAT) as a user-friendly front-end tool to access and analyze data across member states. These Terms of Service apply to all WaDE data and software including WestDAAT.

2.  DISCLAIMER: Individual states have unique water rights administration systems. Please check the metadata and each state’s disclaimer before assessing the data or making any comparisons. The purpose of WaDE is to support regional water data and availability analysis. All provided data is provisional.

3.  This data is not meant for localized decisions. Before drawing any conclusions or comparisons, please consult the state’s water rights agency and its methods. For more info, visit https://westernstateswater.org/wade.

5.  This data, software, and documentation are provided by the Western States Water Council “AS IS,” and any express or implied warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose, are disclaimed.

6.  In no event shall the Western States Water Council nor any of the entities providing financial support be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, loss of use, loss of or corruption of data, or loss of profits; or security breach; or business interruption; procurement of substitute goods or services) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this software or documentation, even if advised of the possibility of such damage.

7.  In order to download the data through WestDAAT, you must register as a user. The personally-identifiable information collected in the registration form is not shared with any third parties, and any statistical information about users will only be reported in the aggregate.

8.  The Western States Water Council encourages community feedback to improve the reliability of data and the ability to exchange data. Voluntary feedback is considered non-confidential. The use of this feedback is in the sole discretion of the WSWC, and may be used without compensation or attribution.

9.  The Western States Water Council logo is copyrighted and may not be copied, imitated, or used without the Western States Water Council’s prior written permission.

10.  From time to time, WestDAAT data or functionality may be updated, and not all services may be available during the update process. Additionally, we reserve the right to suspend or stop providing access to all or portions of the tool at any time.

11.  Any dispute arising from these Terms of Service and your use of WestDAAT will be governed by and construed and enforced in accordance with the laws of Utah, except to the extent preempted by U.S. federal law, without regard to conflict of law rules or principles of any jurisdiction. Any disputes that cannot be resolved outside of court will be resolved in the state or federal courts of Utah and the United States, sitting in Salt Lake County.
